Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Consumer: a natural person who is not acting for purposes related to their trade, business, craft, or profession
  • Cooling-off period: the period during which the consumer can exercise their right of withdrawal
  • Right of withdrawal: the possibility for the consumer to cancel the agreement within the cooling-off period
  • Distance contract: an agreement concluded via the internet or other remote communication methods without physical presence
  • EL Pasha: the company as defined in Article 2
  • Durable medium: any tool that enables the consumer or entrepreneur to store information for future reference

Article 3 – Applicability

  1. These terms and conditions apply to every offer made by EL Pasha and to every agreement concluded between EL Pasha and the consumer.
  2. The terms and conditions are made available before the agreement is concluded.
  3. If the agreement is concluded electronically, these terms can be stored electronically by the consumer.

Article 4 – The Offer

  1. The offer contains a complete and accurate description of the products.
  2. Images used are a truthful representation of the products.
  3. Obvious errors or mistakes in the offer are not binding on EL Pasha.

Article 5 – The Agreement

  1. The agreement is concluded when the consumer accepts the offer and completes payment.
  2. EL Pasha will confirm the order via email.
  3. After confirmation, the order cannot be cancelled, but it may be returned in accordance with the right of withdrawal.
  4. EL Pasha reserves the right to refuse orders in case of suspicion of misuse or risk.

Article 6 – Right of Withdrawal

  1. The consumer has the right to withdraw from the agreement within 14 days.
  2. The cooling-off period starts on the day the consumer receives the product.

Article 7 – Consumer Obligations During the Cooling-Off Period

  1. The consumer must handle the product and packaging with care.
  2. The product may only be used to the extent necessary to assess its nature and characteristics.

Article 8 – Exercise of the Right of Withdrawal

  1. The consumer may exercise the right of withdrawal via the return form or by email.
  2. The product must be returned within 14 days after notification.
  3. The consumer bears the cost of returning the product.

Article 9 – Obligations of EL Pasha in Case of Withdrawal

  1. EL Pasha will confirm receipt of the withdrawal.
  2. Refunds will be issued within 14 days after receiving the returned product.
  3. Refunds will be made using the same payment method used for the original transaction.

Article 10 – Exclusion of the Right of Withdrawal

The right of withdrawal is excluded for:

  • Opened or used products for hygiene reasons (such as perfumes)
  • Sealed products that have been unsealed after delivery
  • Custom-made products

Article 11 – Pricing

  1. All prices include VAT.
  2. Price changes do not affect completed orders.

Article 12 – Performance and Warranty

  1. Products must meet reasonable expectations of quality and usability.
  2. Statutory warranty rights apply.

Article 13 – Delivery and Execution

  1. Delivery takes place at the address provided by the consumer.
  2. Orders are processed as quickly as possible.
  3. If delivery is delayed or cannot be completed, the consumer will be informed.

Article 14 – Duration Transactions

If applicable, ongoing agreements may be terminated by the consumer with a notice period of up to one month.

Article 15 – Payment

  1. Payment must be made via the available payment methods.
  2. The consumer is responsible for providing accurate payment details.

Article 16 – Complaints Procedure

  1. Complaints can be submitted via info@el-pasha.com
  2. Complaints will be handled within 14 days

Article 17 – Disputes

All agreements are governed by Dutch law.
Disputes will be submitted to the competent court in the Netherlands.

Article 18 – Additional Provisions

Additional provisions must not be detrimental to the consumer and must be recorded in writing or on a durable medium.
