Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
Consumer
The natural person who is not acting for purposes related to their trade, business, craft, or profession.
Cooling-Off Period
The period during which the consumer may exercise the right of withdrawal.
Right of Withdrawal
The possibility for the consumer to withdraw from a distance contract within the cooling-off period.
Distance Contract
An agreement concluded between EL Pasha and the consumer through the internet or other means of communication without the simultaneous physical presence of both parties.
EL Pasha
The business as described in Article 2 of these Terms and Conditions.
Durable Medium
Any instrument that enables the consumer or EL Pasha to store information in a way that allows future consultation and unchanged reproduction.
Day
Calendar day.

Article 3 – Applicability
These Terms and Conditions apply to every offer made by EL Pasha and to every agreement concluded between EL Pasha and the consumer.
Before the agreement is concluded, these Terms and Conditions shall be made available electronically to the consumer.
If the agreement is concluded electronically, the consumer shall be able to store these Terms and Conditions on a durable medium.
Any deviations from these Terms and Conditions shall only be valid if expressly agreed upon in writing.
Article 4 – The Offer
The offer contains a complete and accurate description of the products offered.
Obvious errors, mistakes, typographical errors, pricing errors, or other apparent inaccuracies are not binding on EL Pasha.
Images, product photographs, colors, specifications, and descriptions displayed on the website are intended to provide the most accurate representation possible of the products offered. Minor deviations may occur and do not entitle the consumer to compensation or termination of the agreement.
EL Pasha reserves the right to modify, supplement, or discontinue its offers at any time.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer and complies with the conditions attached thereto, including successful payment.
After placing an order, the consumer will receive an electronic order confirmation.
EL Pasha reserves the right to refuse, suspend, or request additional information regarding orders in cases involving:

suspected fraud;
-
unauthorized payments;
-
incorrect customer information;
-
misuse of promotions or discount codes;
-
other circumstances that present an increased risk.
Once an order has been confirmed, it can no longer be cancelled unless EL Pasha expressly agrees otherwise. The statutory right of withdrawal remains fully applicable.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the agreement within fourteen (14) days without providing any reason.
The cooling-off period begins on the day the consumer, or a third party designated by the consumer, receives the product.
To exercise the right of withdrawal, the consumer must clearly inform EL Pasha of their decision within this period.
After notifying EL Pasha of the withdrawal, the consumer has an additional fourteen (14) days to return the product.
Article 7 – Consumer Obligations During the Cooling-Off Period
During the cooling-off period, the consumer must handle the product and its packaging with care.
The consumer may only use the product to the extent necessary to determine its nature, characteristics, and functioning, as would reasonably be permitted in a physical store.
If the product is used beyond what is necessary for such evaluation, the consumer may be liable for any resulting loss in value.
Article 8 – Exercising the Right of Withdrawal and Costs
The consumer may exercise the right of withdrawal by:

completing the return form; or
-
sending an email to info@el-pasha.com.
After notifying EL Pasha of the withdrawal, the product must be returned within fourteen (14) days in accordance with the return instructions provided by EL Pasha.
The costs of returning the product are the responsibility of the consumer.
The risk of loss, damage, or delay during return transit remains with the consumer until the product has been received by EL Pasha.
EL Pasha recommends using an insured and trackable shipping method.
Article 9 – Obligations of EL Pasha in the Event of Withdrawal
Upon receiving the withdrawal notice, EL Pasha will acknowledge receipt.
EL Pasha shall refund all payments received, including the standard delivery costs of the original shipment, no later than fourteen (14) days after receiving the withdrawal notice.
EL Pasha may withhold the refund until:
-
the returned product has been received; or
-
the consumer has provided sufficient proof that the product has been returned.
Refunds will be made using the same payment method used for the original transaction unless otherwise expressly agreed.
Customers may voluntarily choose to receive their refund in the form of store credit or a digital gift card. This choice does not affect the customer's statutory right to a refund.
Article 10 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for products as permitted under applicable law.
This includes, but is not limited to:
-
sealed products that are not suitable for return due to health protection or hygiene reasons and whose seal has been broken after delivery;
-
opened, used, or damaged perfume products;
-
products that are clearly personal in nature;
-
custom-made or personalized products;
-
products that, by their nature, cannot be returned.
Where a product falls under a statutory exception, this will be clearly indicated on the product page or during the ordering process.
Article 11 – Prices
All prices displayed on the website include VAT unless explicitly stated otherwise.
Any import duties, customs fees, local taxes, customs clearance charges, or other levies imposed outside the European Union are entirely the responsibility of the customer.
Price changes do not affect orders that have already been placed and confirmed.
Obvious pricing errors, technical errors, or mistakes are not binding on EL Pasha. If a product has inadvertently been offered at an incorrect price, EL Pasha reserves the right to cancel the order and refund any amounts already paid.
Article 12 – Compliance and Warranty
EL Pasha guarantees that the products supplied conform to the agreement, the reasonable expectations that the customer may have of them, and the legal requirements applicable at the time of delivery.
The statutory warranty applicable within the European Union remains fully in force.
Any complaint regarding a product must be reported to EL Pasha as soon as possible after the defect has been discovered.
Normal wear and tear, improper use, improper storage, damage caused by the customer, or damage occurring after delivery are not covered by any warranty.
Article 13 – Delivery and Performance
Delivery will take place at the address provided by the customer during the ordering process.
EL Pasha strives to process and dispatch orders as quickly as possible.
Any stated delivery times are indicative and do not constitute strict deadlines. Exceeding a stated delivery time does not automatically entitle the customer to compensation or cancellation of the agreement.
If an order is delayed or cannot be fulfilled in full, the customer will be informed as soon as reasonably possible.
The risk of loss or damage to products transfers to the customer once the order has been received by the customer or a third party designated by the customer.
EL Pasha is not liable for delays caused by carriers, customs procedures, local regulations, or circumstances beyond its reasonable control.
Article 14 – Ongoing Agreements
If an agreement has been entered into for an indefinite period, the customer may terminate the agreement at any time, subject to a notice period of no more than one month.
If an agreement for a fixed period is automatically renewed, the customer has the right to terminate the renewed agreement with a notice period of no more than one month.
Article 15 – Payment
Payment must be made using the payment methods offered by EL Pasha on the website.
The customer is responsible for providing accurate, complete, and up-to-date payment and contact information.
If a payment is declined, cancelled, reversed, or otherwise unsuccessful, EL Pasha reserves the right to suspend or cancel the order.
EL Pasha also reserves the right to request additional verification if there is an increased risk of fraud, unauthorized transactions, suspicious activity, or other circumstances that may pose a risk to the company or its payment partners.
Article 16 – Complaints Procedure
Complaints regarding products, orders, or services may be submitted via:

EL Pasha aims to provide a substantive response to complaints within fourteen (14) days of receipt.
If a complaint requires additional processing time, the customer will receive a notification within this period indicating the expected timeframe for resolution.
Submitting a complaint does not suspend the customer's payment obligations.
Article 17 – Disputes and Applicable Law
All agreements between EL Pasha and the customer shall be governed exclusively by Dutch law.
Any disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer protection laws provide otherwise.
If any provision of these Terms and Conditions is found to be wholly or partially invalid, the remaining provisions shall remain fully effective.
Article 18 – International Shipping
EL Pasha ships to multiple countries both within and outside the European Union.
International orders may be subject to additional import duties, taxes, customs charges, customs clearance fees, or other local charges.
These charges are entirely the responsibility of the customer and fall outside the responsibility of EL Pasha.
EL Pasha is not responsible for delays resulting from:

customs procedures;
-
import inspections;
-
local regulations;
-
international carriers;
-
government actions.
The customer is solely responsible for verifying any import restrictions or product regulations that apply in the destination country.
Article 19 – Force Majeure
EL Pasha shall not be liable for any delay or failure to perform its obligations if such delay or failure results from force majeure.
Force majeure includes, but is not limited to:

natural disasters;
-
pandemics;
-
wars;
-
terrorist threats;
-
strikes;
-
government measures;
-
internet outages;
-
payment provider disruptions;
-
carrier disruptions;
-
power outages;
-
technical failures;
-
other circumstances beyond the reasonable control of EL Pasha.
During a force majeure event, EL Pasha's obligations shall be suspended.
If the force majeure situation continues for longer than may reasonably be expected, EL Pasha reserves the right to terminate the agreement in whole or in part without any obligation to pay compensation.
Article 20 – Additional Provisions
Additional provisions or deviations from these Terms and Conditions may not be detrimental to the customer and must be recorded in writing or on a durable medium.
If any provision of these Terms and Conditions is found to be null, void, or unenforceable, the remaining provisions shall remain fully effective.
EL Pasha reserves the right to amend or supplement these Terms and Conditions. The most recent version will always be published on the EL Pasha website.
By placing an order, the customer declares that they have read, understood, and agreed to these Terms and Conditions.
